Please read these rules before participating in the Scary People Scaring People giveaway (the “Promotion”). By participating, you acknowledge that you have read and agree to be bound by these Official Rules and the decisions of Scary People Scaring People (“The Promotor”) that you satisfy all eligibility requirements. 

This Promotion is in no way sponsored, endorsed, or administered by YouTube or Mob Entertainment. YouTube and Mob Entertainment are completely released of all liability be each Entrant in this Promotion. 

Eligibility:

• Entrants must be (1) at least 13 years of age on the date of their entry, (2) residents of the United States, and (3) must have a YouTube account. Eligible Entrants who are less than the age of majority in their jurisdiction of residents (a “minor”) must have their parent/legal guardian’s permission prior to entering. Participation in the Promotion must comply with the YouTube Terms of Use located at www.youtube.com/t/terms and the YouTube Community Guidelines located at www.youtube.com/yt/policyandsafety/communityguidelines.html. In the event an Entrant resides in a jurisdiction where the YouTube Terms of Use or Community Guidelines specific to their jurisdiction require the Entrant to be at least the age of majority in their jurisdiction of residence to access and use the YouTube website platform, such Entrant will not be permitted to enter the Promotion unless they are at least the age of majority in the applicable jurisdiction of residence. Promotion is void where prohibited by law.

• Entrants must be eligible to participate in this Promotion and comply with these Official Rules or the Entrant in question may be disqualified.

Promotion Period: The Promotion will start on February 24, 2025 at 2:00 PM PT. All entries must be received by 11:59 PM PT on March 2, 2025 (“Promotion Period”). Only entries submitted before the deadline will be considered.

How to Enter:

• Each entrant must enter the competition via YouTube by: (1) subscribing to the Scary People Scaring People page and (2) tagging two other YouTube users in the comments of the specified post. Even if a Participant makes more than one comment or tags more than two users, they will be given only one entry in the giveaway.

• Limit of one entry per person using only one YouTube account. If any person obtains more than one entry using more than one YouTube account, only the first entry received from such Entrant will be considered for the Promotion.

Winner Determination and Notification:  One (1) potential winner in the United States will be selected by The Promoter in a random drawing and posted on The Promoter’s YouTube account on or about 5:30 pm PT on March 4, 2025. The potential winner will be drawn from all eligible entries received throughout the Promotion Period. The potential winner will be notified via YouTube public chat or comment or livestream and will be required to respond to the notification within two weeks to accept the prize. If a potential winner cannot be reached, or in the event of noncompliance with the Official Rules, such potential winner will be disqualified and an alternate potential winner may be notified. The name, address, email address and phone number of the winner must be provided to The Promoter if requested and will be shared to enable fulfilment of the Prize.​

Prize: The winner will receive one Poppy Playtime Mystery Plush box. The Promoter will not be held liable if the named prize becomes unavailable or cannot be fulfilled. Prizes are non-negotiable, non-transferable and non-refundable. No cash alternative is available. Where a Prize becomes unavailable for any reason, the promoter reserves the right to substitute that prize for a prize of equal or higher value. ALL TAXES ASSOCIATED WITH THE PRIZE ARE THE SOLE RESPONSIBILITY OF EACH WINNER.

Publicity: Except where prohibited by law, the prize winner consents to use of their YouTube account username worldwide without compensation, notice or approval, on The Promotor’s social media and YouTube accounts after the winner has been selected.

Waiver, Release, and Limitation of Liability: The Promoter will not be held liable for any failure of receipt of entries. The Promoter takes no responsibility for any entries which are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid. To the extent permitted by applicable law, The Promoter’s liability under or in connection with the competition or these terms and conditions shall be limited to the cost price of the Prize in question. 

By participating, Entrants agree to be bound by these Official Rules. Entrants agree (for themselves and their heirs) that The Promotor will have no liability, and will be held harmless by such Entrants to the maximum extent permitted by law for any liability, loss, injury, or damage to property or to person, including death, and reasonable attorney’s fees and court costs, due in whole or in part, directly or indirectly, by reason of participation in the Promotion, or by reason of the acceptance, possession, use or misuse of the prizes, even if caused or contributed to by the negligence of The Promotor or its affiliates.

EACH ENTRANT ACCEPTS THE CONDITIONS STATED IN THESE OFFICIAL RULES, AGREES TO BE BOUND BY THE DECISIONS OF THE PROMOTER, WARRANTS THAT THEY ARE ELIGIBLE TO PARTICIPATE IN THIS PROMOTION, AND AGREE TO RELEASE, INDEMNIFY, AND HOLD HARMLESS THE PROMOTER AND THEIR PERSONNEL FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, LIABILITY, AND DAMAGES OF ANY KIND (INCLUDING REASONABLE ATTORNEYS’ FEES AND EXPENSES) ASSERTED AGAINST ANY OF THEM, INCURRED OR SUSTAINED IN CONNECTION WITH OR ARISING OUT OF ENTRANT’S PARTICIPATION IN THIS PROMOTION, OR ANY TRAVEL OR ACTIVITY RELATED THERETO, BREACH OF ANY AGREEMENT OR WARRANTY ASSOCIATED WITH THE PROMOTION, INCLUDING THESE OFFICIAL RULES. ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, THE PROMOTOR RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH PERSON(S) RESPONSIBLE FOR ANY SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

General Conditions: By participating, each Entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of The Promotor, which are final and binding in all matters related to the Promotion. The Promotor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the operation of the Promotion or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner and void all associated submissions. The Promoter will not permit any comments or opinions that are considered inappropriate, offensive, insulting or discriminatory, or could violate the rights of third parties. The Promoter will not be responsible for any damages caused by comments made by Participants. Participation in this Promotion may not violate the YouTube Terms of Service or Community Guidelines.

Entrants agree to release and hold harmless Promotion Entities from any claims, actions, injury, liability, loss or damage of any kind resulting from participating in this Promotion or from the acceptance or use of any prize awarded. In the event of unforeseen circumstances beyond The Promoter’s reasonable control, the promoter reserves the right to cancel, terminate, modify or suspend the competition or these terms and conditions, either in whole or in part, with or without notice. Decisions of The Promotor relating to the Promotion are final.

These Terms and Conditions will be governed in accordance with the laws of the State of California. As a condition of participating in this Promotion, Entrants agree that any and all disputes which cannot be resolved between the parties and causes of action arising out of or in connection with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the State of California having jurisdiction. Further, in any such dispute, under no circumstances will Entrants be permitted to obtain awards for, and hereby waive all rights to claim, punitive, incidental or consequential damages, including attorneys' fees, other than Entrant’s actual out-of-pocket expenses (e.g. costs associated with entering), and Entrant further waives all rights to have damages multiplied or increased.
